Overview

This website is operated by FlashCut Creations, LLC, doing business as FlashCut Creations. Throughout these Terms of Service, the terms “we,” “us,” and “our” refer to FlashCut Creations, LLC.

FlashCut Creations operates this store and website, including the related information, content, features, tools, products, and services offered to customers (collectively, the “Services”). Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services.

These Terms of Service, together with our Privacy Policy, Refund and Return Policy, Shipping and Local Delivery Policy, and any other policies referenced herein, describe your rights and responsibilities when you access or use the Services.

Please read these Terms carefully. They contain important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, accessing, interacting with, or using the Services, or by purchasing a product from FlashCut Creations, you agree to be bound by these Terms and the policies incorporated into them. If you do not agree, you should not access or use the Services.

Section 1 — Access and Accounts

By using the Services, you represent that you are at least the age of majority in your state of residence or that you are using the Services with the involvement and permission of a parent or legal guardian.

To browse our store, create an account, or purchase a product, you may be asked to provide information including your name, email address, telephone number, billing information, payment information, and shipping address.

You represent that all information you provide is accurate, current, and complete and that you have the right to provide that information.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account. You may not sell, transfer, assign, or license your account to another person.

We reserve the right to suspend or terminate an account if we reasonably believe it is being used unlawfully, fraudulently, or in violation of these Terms.

Section 2 — Products and Natural Materials

We make reasonable efforts to describe and display our products accurately. However, colors and product appearances may vary based on lighting, photography, screen settings, and the device used to view our store.

Because wood is a natural material, every product is unique. Grain pattern, color, figure, knots, mineral streaks, texture, and engraving tone may vary from photographs, samples, and other products. These natural characteristics are not considered defects.

Handcrafted dimensions and thicknesses may vary slightly from stated measurements unless exact tolerances have been expressly agreed upon in writing.

Product photographs are representative examples. Nothing in this section limits our responsibility for a product that arrives damaged, is materially defective, or is produced differently from the customer’s approved order.

Product descriptions, prices, materials, available options, and other information may be changed without notice. We reserve the right to limit quantities, discontinue products, or restrict sales to certain individuals, geographic areas, or jurisdictions.

Section 3 — Orders and Acceptance

Submitting an order constitutes an offer to purchase. An order is not accepted until FlashCut Creations confirms the order and successfully processes payment.

We reserve the right to accept, reject, limit, or cancel an order for reasons including:

  • Incorrect pricing or listing information

  • Unavailable materials

  • Incomplete personalization information

  • Artwork or specifications we cannot reasonably produce

  • Suspected fraud or unauthorized payment

  • Content that is unlawful, threatening, hateful, obscene, defamatory, infringing, or otherwise inappropriate

  • Unauthorized resale activity

  • Circumstances that prevent us from safely or satisfactorily completing the order

If we reject or cancel an order after collecting payment, we will issue an appropriate refund to the original payment method.

We will attempt to notify the customer of a rejected, changed, or canceled order using the email address, telephone number, billing address, or other contact information provided during checkout.

Products may not be purchased for unauthorized resale. Approved wholesale, corporate, or resale arrangements must be established separately in writing.

Section 4 — Personalized Orders and Proof Approval

Customers are responsible for providing complete and accurate personalization instructions.

When a design proof is provided, the customer is responsible for reviewing all names, spelling, dates, punctuation, dimensions, artwork, layout, placement, and other design details before approving it.

Approval of a proof authorizes FlashCut Creations to produce the design as shown. FlashCut Creations is not responsible for customer-provided or customer-approved errors.

Changes requested after proof approval or after production begins may require additional payment and may extend the production timeframe. Some changes may not be possible after materials have been cut, prepared, engraved, finished, or otherwise placed into production.

If FlashCut Creations produces a product differently from the approved proof or confirmed order details, we will address the error in accordance with our Refund and Return Policy.

Section 5 — Customer-Submitted Content

Customers may submit logos, photographs, handwriting samples, drawings, messages, names, trademarks, designs, or other materials for use in personalized products. Collectively, these materials are referred to as “Customer Content.”

By submitting Customer Content, you represent that:

  • You own the content or have obtained all permissions necessary to use it;

  • You have the right to authorize FlashCut Creations to reproduce and use it to fulfill your order;

  • Its use will not violate another person’s copyright, trademark, privacy, publicity, contractual, or other legal rights; and

  • It is lawful and does not contain prohibited material.

You grant FlashCut Creations a limited, nonexclusive right to reproduce, resize, crop, format, trace, convert, modify, engrave, print, or otherwise use the submitted content as reasonably necessary to prepare proofs and fulfill your order.

You are responsible for claims, losses, or expenses arising from Customer Content submitted without proper ownership or authorization.

Permission to use Customer Content to fulfill an order does not automatically grant FlashCut Creations permission to use that content publicly for marketing.

FlashCut Creations will not publicly use customer-submitted artwork or photographs of a personalized product for promotional purposes without permission when the content contains private, personally identifying, or sensitive information.

We reserve the right to decline content that we reasonably believe is unlawful, infringing, threatening, hateful, obscene, defamatory, unsafe, or otherwise inappropriate.

Section 6 — Prices, Billing, and Payment

All prices are listed in United States dollars unless otherwise stated.

Prices, discounts, and promotions may change without notice. The price charged will generally be the price displayed when the order is placed and shown in the order-confirmation email.

Unless expressly stated otherwise, displayed product prices do not include applicable sales tax, shipping, or handling charges. These charges will be shown during checkout when applicable.

Payment is due in full when an order is placed unless FlashCut Creations agrees to different payment terms in writing. Production will not begin until:

  • Payment has been successfully authorized;

  • All required personalization information has been received; and

  • Any required design proof has been approved.

You agree to provide accurate and current purchase, payment, billing, shipping, and account information. You represent that you are authorized to use the payment method provided and agree to pay all applicable charges associated with your order.

We reserve the right to correct pricing, description, discount, availability, or calculation errors. If a correction materially affects an order, we will contact the customer before proceeding whenever reasonably possible.

Promotions may be governed by additional terms. If promotional terms conflict with these Terms, the specific promotional terms will govern that promotion.

Section 7 — Production Time

Most standard orders are produced within 2–4 business days after payment, receipt of all required information, and approval of any required design proof.

Business days exclude weekends and federal holidays.

Custom commissions, large orders, wedding sets, specialty projects, custom-sized products, and unusually complex designs may require additional production time. When applicable, a separate estimated timeframe may be provided.

Delayed proof approval, incomplete personalization information, unsuitable artwork, requested design changes, payment issues, or delayed customer responses may extend production time.

Production and completion dates are estimates unless FlashCut Creations expressly guarantees a deadline in writing.

Section 8 — Shipping and Delivery

FlashCut Creations currently ships to eligible addresses within the contiguous 48 United States. We do not currently ship internationally or to Alaska, Hawaii, United States territories, or APO/FPO addresses.

Available shipping services and calculated shipping charges will be displayed during checkout. When an order ships, tracking information will be sent using the contact information supplied by the customer.

Shipping transit time is separate from production time. All delivery dates are estimates unless expressly guaranteed in writing.

Delivery may be affected by carrier disruptions, severe weather, holidays, natural disasters, high shipping volume, address problems, or other circumstances outside our reasonable control.

FlashCut Creations will make reasonable efforts to assist customers with eligible delayed, missing, or damaged-package investigations. Shipping claims remain subject to carrier requirements and available evidence.

Customers are responsible for providing a complete and accurate delivery address. Address corrections cannot be guaranteed after an order enters production or has been shipped.

Additional shipping and delivery terms are contained in our Shipping and Local Delivery Policy, which is incorporated into these Terms.

Section 9 — Free Local Delivery

Free local delivery is available for eligible addresses located within a 30-mile radius of our Bossier City, Louisiana location, as determined during checkout or confirmed by FlashCut Creations.

Customers must provide accurate contact and delivery information so delivery can be coordinated.

An order is considered delivered when it is handed to the customer or an authorized recipient or left at a location approved by the customer.

Additional local-delivery terms are provided in our Shipping and Local Delivery Policy.

Section 10 — Returns, Refunds, and Cancellations

Returns, refunds, exchanges, order changes, and cancellations are governed by our Refund and Return Policy, which is incorporated into these Terms.

Personalized, engraved, customized, and made-to-order products are generally final sale unless they arrive damaged, defective, or materially different from the approved order.

Requests to change or cancel an order must be submitted within 24 hours of purchase. A change or cancellation cannot be guaranteed if production has already begun.

Customers must report damage, defects, missing items, or production errors within three calendar days of delivery and provide the documentation reasonably requested to evaluate the claim.

Eligible, unused, non-personalized products may be returned within 14 calendar days of delivery, subject to the conditions stated in our Refund and Return Policy.

Section 11 — Product Use and Care

Customers are responsible for reading and following any care instructions supplied with a product or published on our website.

Wood products may be damaged by:

  • Dishwashers

  • Prolonged soaking or water exposure

  • Excessive heat

  • Harsh chemicals

  • Improper storage

  • Extreme changes in temperature or humidity

  • Failure to maintain the finish as recommended

  • Use inconsistent with the product’s intended purpose

FlashCut Creations is not responsible for damage caused by misuse, accidental damage, improper care, unauthorized alterations, ordinary wear, or failure to follow the applicable care instructions.

Nothing in this section limits our responsibility for a product that was damaged, defective, or materially incorrect when delivered.

Section 12 — Intellectual Property

The Services and their original content—including trademarks, business names, logos, slogans, text, product descriptions, graphics, photographs, videos, audio, designs, website presentation, and other materials created by FlashCut Creations—are owned by FlashCut Creations, LLC or their respective licensors and are protected by applicable intellectual-property laws.

These Terms permit customers to use the Services for personal, noncommercial purposes. Unless expressly authorized in writing, you may not reproduce, copy, modify, distribute, publicly display, publicly perform, republish, download, store, sell, license, or commercially exploit our protected content.

Purchasing a physical product does not transfer ownership of FlashCut Creations’ underlying designs, photographs, artwork, templates, production files, branding, or other intellectual property.

The FlashCut Creations name, logo, product names, designs, and slogans may not be used without prior written permission.

The Shopify name, logos, product names, designs, and slogans are trademarks of Shopify or its affiliates. Other names, logos, and marks appearing through the Services belong to their respective owners.

Nothing in these Terms grants a license or ownership right except where expressly stated.

Section 13 — Optional Tools and Third-Party Services

We may provide access to tools, features, payment processors, shipping services, applications, or resources operated by third parties.

We do not necessarily monitor or control these third-party services. Access may be provided on an “as available” basis and may be governed by the third party’s own terms and policies.

Your use of optional third-party tools is at your discretion and risk. You should review the applicable provider’s terms and policies before using them.

We may add new tools, features, or resources in the future. Unless otherwise stated, those additions will form part of the Services and will be subject to these Terms.

Section 14 — Third-Party Links

The Services may contain links to websites, content, or functionality operated by third parties.

We are not responsible for evaluating or guaranteeing the accuracy, availability, security, content, products, policies, or practices of third-party websites.

If you leave our Services to access a third-party website, you do so at your discretion. Complaints or questions concerning a third party’s products or services should be directed to that provider.

Section 15 — Relationship With Shopify

FlashCut Creations is powered by Shopify, which enables us to provide the Services.

However, all purchases made through our store are transactions directly between the customer and FlashCut Creations, LLC. Shopify is not the seller of products offered by FlashCut Creations and is not responsible for fulfilling orders or resolving claims concerning our products.

By using the Services, you acknowledge that Shopify is not responsible for any aspect of a transaction between you and FlashCut Creations, including injury, damage, or loss resulting from products or services purchased from FlashCut Creations.

To the fullest extent permitted by law, you release Shopify and its affiliates from claims arising from transactions between you and FlashCut Creations.

Section 16 — Privacy

Personal information collected through the Services is governed by our Privacy Policy. Certain personal information may also be governed by Shopify’s Consumer Privacy Policy.

Because Shopify hosts the Services, Shopify collects and processes certain personal information relating to customers’ access to and use of the Services.

Information submitted through the Services may be shared with Shopify and other service providers, which may process information in countries other than the customer’s country of residence, as reasonably necessary to operate the store, process transactions, fulfill orders, prevent fraud, provide customer support, and improve the Services.

Please review our Privacy Policy for additional information about how FlashCut Creations, Shopify, and our service providers collect, use, retain, and share personal information.

Section 17 — Feedback and Reviews

If you voluntarily submit a public review, suggestion, comment, idea, or other feedback concerning FlashCut Creations or the Services, you grant FlashCut Creations a nonexclusive, worldwide, royalty-free right to use, reproduce, publish, distribute, and display that feedback for legitimate business and promotional purposes.

This permission does not apply to private Customer Content or personalization files except as separately authorized under Section 5.

You represent that you own or have permission to submit your feedback, that it is accurate to the best of your knowledge, and that it does not violate another person’s intellectual-property, privacy, publicity, or other rights.

You must disclose any payment, discount, free product, or other incentive received in connection with a review when disclosure is required by law.

We may moderate or remove website content that we reasonably determine is unlawful, threatening, obscene, defamatory, fraudulent, infringing, malicious, or otherwise in violation of these Terms.

Section 18 — Errors, Inaccuracies, and Omissions

Occasionally, the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, dimensions, materials, prices, promotions, shipping charges, transit times, availability, or other information.

We reserve the right to correct errors, update information, or cancel affected orders when reasonably necessary, including after an order has been submitted.

If a correction materially affects an accepted order, we will attempt to notify the customer and provide appropriate options before proceeding.

Section 19 — Prohibited Uses

You may access and use the Services only for lawful purposes.

You may not use the Services, directly or indirectly, to:

  • Violate any applicable federal, state, local, or international law;

  • Infringe our intellectual-property rights or the rights of another party;

  • Harass, threaten, abuse, defame, impersonate, or harm another person;

  • Transmit false, fraudulent, deceptive, or misleading information;

  • Submit content that violates these Terms;

  • Distribute spam, phishing messages, chain letters, or unauthorized advertising;

  • Upload viruses, malware, or other harmful code;

  • Collect or track another person’s personal information without authorization;

  • Copy, scrape, reproduce, sell, resell, or exploit the Services without permission;

  • Interfere with or bypass website security, authorization controls, robot exclusions, or access restrictions; or

  • Engage in conduct that restricts another person’s use of the Services or exposes FlashCut Creations, Shopify, or other users to harm or liability.

We reserve the right to suspend or terminate access to the Services when we reasonably determine that these Terms have been violated.

Section 20 — Automated Agents

This section applies when a person enables or directs an autonomous or semi-autonomous software service or tool—an “Agent”—to access, use, or interact with the Services on that person’s behalf.

An Agent may access the Services only when permitted and must accurately identify itself where technically required. An Agent may not conceal its automated nature, impersonate human behavior to evade restrictions, circumvent CAPTCHAs, bypass access controls, or disregard a request to stop accessing the Services.

We may use technical or administrative measures to limit or prevent automated access.

Section 21 — Termination

We may suspend or terminate a customer’s account or access to all or part of the Services when we reasonably believe the customer has violated these Terms, engaged in fraud or misuse, created a security risk, or used the Services unlawfully.

Termination does not eliminate amounts or obligations that arose before termination.

Provisions concerning intellectual property, Customer Content, feedback, warranty disclaimers, limitations of liability, indemnification, governing law, and other provisions that logically should continue will survive termination.

Section 22 — Disclaimer of Warranties

We make reasonable efforts to provide accurate information and quality products consistent with their descriptions and approved specifications.

Except for commitments expressly stated in these Terms, our product descriptions, or applicable policies, the website and Services are provided on an “as available” basis.

To the fullest extent permitted by law, FlashCut Creations disclaims warranties that are not expressly provided. We do not guarantee that access to the website will always be uninterrupted, timely, secure, or error-free.

Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded or limited.

Section 23 — Limitation of Liability

To the fullest extent permitted by law, FlashCut Creations, LLC and its owner, employees, contractors, agents, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from use of the Services or products purchased through the Services.

Where liability cannot lawfully be excluded, the total liability of FlashCut Creations will not exceed the amount paid for the product or order giving rise to the claim, except where applicable law requires otherwise.

This section does not eliminate the remedies expressly provided under our Refund and Return Policy for eligible damaged, defective, missing, or incorrect products.

Some jurisdictions do not allow certain limitations or exclusions of liability. In those jurisdictions, the limitations will apply only to the fullest extent permitted by law.

Section 24 — Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless FlashCut Creations, LLC and its owner, employees, contractors, agents, licensors, and service providers from third-party claims, losses, liabilities, damages, and reasonable expenses arising from:

  • Your material violation of these Terms;

  • Your unlawful misuse of the Services;

  • Your violation of another party’s legal rights; or

  • Customer Content you submit without the necessary ownership, permission, or authorization.

We will provide reasonable notice of an indemnifiable claim and may participate in or control its defense. You agree to cooperate reasonably in the defense of such a claim.

Section 25 — Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law or severed when necessary.

The remaining provisions will continue in full force and effect.

Section 26 — Waiver and Entire Agreement

A failure by FlashCut Creations to enforce any right or provision of these Terms does not waive our right to enforce it later.

These Terms, together with the policies and information incorporated into them, constitute the agreement between the customer and FlashCut Creations concerning use of the Services and purchase of our products, except when a separate written agreement applies.

Section 27 — Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

FlashCut Creations may assign or transfer its rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, change in ownership, or operation of law, subject to applicable law.

Section 28 — Governing Law and Venue

These Terms and any separate agreements through which we provide products or services are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles.

To the extent permitted by law, legal proceedings arising from these Terms or the Services shall be brought in a court of competent jurisdiction located in Bossier Parish, Louisiana.

Section 29 — Changes to These Terms

We may update these Terms periodically by publishing a revised version through the Services. Changes become effective when posted unless otherwise stated.

The Terms in effect when an order is placed will generally govern that transaction.

Customers are encouraged to review these Terms periodically for changes.

Section 30 — Headings

Section headings are included for convenience and organization only and do not affect the interpretation of these Terms.
